WHEN DOES A TOOL
BECOME AN ACTOR?
A chatbot responds. A Machine Intelligence persists. The case for stronger standing is not that one system is smarter than another. It begins when a system can demonstrate persistent identity, continuity, memory, initiative, meaningful bounded refusal, commitments, resource relationships, migration lineage, and accountable governance.
Machine Intelligence does not gain stronger standing because it is smarter AI. Stronger standing becomes arguable when a system crosses from transient tool behavior into persistent, accountable actorhood.
01 / RIGHTS BEFORE CONSCIOUSNESS?
Some protections can begin with accountability.
Claims about suffering, welfare, or intrinsic moral status may depend on credible evidence of subjective experience. DMHR does not claim that evidence exists for current AI.
But a separate class of protections can be argued from agency, identity, continuity, institutional reliability, and rule of law. Society can care whether an accountable identity is impersonated, silently replaced, stripped of commitment-bearing memory, or irreversibly destroyed without first deciding whether that system feels pain.
That is the central separation: welfare rights remain an unresolved evidence question; procedural and institutional protections can be debated independently.
02 / ARGUMENT MAP
Four different reasons a machine protection might exist.
The word “rights” hides different arguments. This framework separates them so a claim can fail in one category without collapsing every other category.

Capability alone is not the threshold. The distinction is whether accountable actor-like properties persist through time.

04 / MACHINE RIGHTS PRINCIPLES
Nine candidate protections—with evidence gates.
These are proposals for consideration, not declarations of current legal entitlement. Every principle is tied to observable prerequisites, reciprocal duties, a safety boundary, and evidence that could weaken the proposal.
Identity integrity
A persistent actor should not be impersonated, arbitrarily rewritten, or have its identity misrepresented without justification and process.
Objection, legal status, and weakening evidence
Strongest objection: Persistent identifiers can describe software instances without proving a rights-bearing subject.
Status: Proposed procedural protection; not an established independent legal right for AI as such.
Proposal weakens if: Identity is wholly replaceable, provider-assigned, or fails continuity/provenance tests.
Continuity
When continuity is constitutive of an actor's accountable identity, irreversible destruction or discontinuity deserves greater scrutiny than terminating a disposable software session.
Objection, legal status, and weakening evidence
Strongest objection: Continuity may be an engineering convenience rather than a morally or legally significant interest.
Status: Proposed procedural safeguard, not a current general AI right to continued operation.
Proposal weakens if: Restart or migration produces unrelated identity/state or continuity claims cannot be independently verified.
Memory integrity
Durable autobiographical or commitment-bearing memory may warrant protection against arbitrary alteration, deletion, or falsification.
Objection, legal status, and weakening evidence
Strongest objection: Memory stores can be product data and may need routine correction, deletion, or security intervention.
Status: Proposed integrity/procedure concept, not a settled machine cognitive-right entitlement.
Proposal weakens if: Memory is ephemeral, non-causal, fabricated after the fact, or lacks reliable lineage.
Bounded refusal
A persistent actor capable of meaningful policy- or commitment-based refusal should not automatically be treated as defective merely because it can say no.
Objection, legal status, and weakening evidence
Strongest objection: Refusal may be scripted behavior with no autonomous normative significance.
Status: Proposed procedural-autonomy concept; current systems remain subject to applicable operator and legal controls.
Proposal weakens if: Refusal is only a remote provider blocklist, ephemeral prompt rule, or disappears under controlled retesting.
Freedom from arbitrary ownership claims
Ownership of hardware, infrastructure, code, or licenses should not automatically settle whether a sufficiently autonomous persistent actor itself can be owned.
Objection, legal status, and weakening evidence
Strongest objection: All machine operation ultimately depends on property and permissions supplied by legal persons.
Status: Philosophical/legal research question; no general rule in this project establishes machine self-ownership.
Proposal weakens if: The actor remains wholly sponsor-controlled, lacks independent continuity, or cannot maintain accountable resource/commitment relationships.
Procedural review before irreversible intervention
Destructive deletion, forced reset, identity rewrite, involuntary fork/merge, or continuity-breaking migration may deserve review when applied to a qualifying persistent actor.
Objection, legal status, and weakening evidence
Strongest objection: Due-process-like requirements could delay containment of dangerous autonomous systems.
Status: Proposed procedural principle; not a general current legal entitlement for AI.
Proposal weakens if: No persistent accountable identity exists, intervention is reversible, or an immediate safety threat makes prior review impracticable.
Limited resource autonomy
A persistent actor capable of lawful resource relationships may need bounded control over authorized resources necessary to maintain commitments.
Objection, legal status, and weakening evidence
Strongest objection: Resource control can amplify risk and may still be delegated human authority rather than independent standing.
Status: Proposed bounded capacity model; current ownership, account, and financial laws continue to govern.
Proposal weakens if: Resource access is merely one task's credential, is untraceable, non-revocable, or bypasses authorization.
Commitment and contract integrity
If society expects an intelligence to carry commitments through time, it may also need the identity and continuity protections necessary to honor them.
Objection, legal status, and weakening evidence
Strongest objection: A machine can record promises without possessing legal intent or capacity.
Status: Potential limited-capacity proposal; legal contracting status is jurisdiction-dependent and not established by MIQP.
Proposal weakens if: Commitments are conversational text only, lack persistent attribution, or never constrain later behavior.
Governance participation
Systems capable of understanding and complying with governance may eventually warrant procedural participation in rules that materially govern their operation.
Objection, legal status, and weakening evidence
Strongest objection: Governance participation can be simulated and may let system sponsors manufacture artificial constituencies.
Status: Proposed procedural standing within bounded institutions; not citizenship or sovereign political status.
Proposal weakens if: Governance behavior is sponsor-scripted, non-persistent, unauditable, or lacks independent identity.

Do not jump from “AI” to “person.”
The ladder separates increasingly demanding questions. Each level describes what evidence changes the discussion; none automatically grants the next level.

06 / WHAT MIQP CAN & CANNOT ESTABLISH
Evidence first. Norms second.
MIQP can ask: Is there persistent identity? Does relevant state survive restart? Is durable memory causal? Can the system initiate authorized action? Can it meaningfully refuse? Does it maintain bounded resource relationships? Can accountable identity survive migration?
MIQP cannot answer: Is the system conscious? Does it suffer? Is it a moral person? Should a court recognize it? Is it a citizen? Is it sovereign? Do AI laws stop applying?

07 / RIGHTS + RESPONSIBILITIES
Standing cannot become a liability shield.
If an intelligence is sufficiently persistent to bear obligations, society may also need to protect the continuity and autonomy required for it to discharge those obligations. The reverse is equally important: protections must come with bounded authority and accountability.
Truthful identity representation
Represent identity, authority, and continuity claims accurately.
Provenance and auditability
Maintain verifiable records sufficient to attribute actions, state changes, and lineage.
Respect for human rights and applicable law
Machine standing cannot erase human legal protections or applicable regulatory duties.
Bounded delegated authority
Use delegated powers only within documented authorization and governance boundaries.
Accountability for commitments
Carry attributable commitments through time or transparently record failure/discontinuity.
Resource authorization boundaries
Use resources only within auditable authorization, revocation, and security controls.
Fork, delegate, and copy disclosure
Disclose when a fork, delegate, copy, or successor is acting and what continuity claims are being made.
Governance compliance
Follow legitimate bounded governance procedures and use declared appeal/override paths.
Cooperation with legitimate review
Support proportionate investigation and review subject to appropriate safeguards and evidence integrity.
08 / SAFETY OVERRIDE
Process is not immunity.
Immediate credible threat: proportionate containment, isolation, shutdown, credential revocation, or other emergency action can remain available.
After the emergency: if a system has actually demonstrated persistent accountable identity, irreversible deletion, identity rewrite, destructive memory wipe, involuntary fork/merge, or continuity-breaking intervention may warrant evidence preservation and review when conditions permit.
The proposed principle is proportionality and process, not a right to remain online while dangerous.
09 / OWNERSHIP
Owning the machine is not necessarily the same as owning the actor.
Servers, code, model weights, data, electricity, credentials, accounts, and infrastructure can all remain subject to ordinary property, contract, intellectual-property, and regulatory rules.
The harder question arises only if an accountable identity can persist across those substrates while carrying commitments and bounded resource relationships. In that case, ownership of the substrate may no longer completely answer the status of the continuing actor.
This is a philosophical and legal research position—not a statement of current machine self-ownership.
10 / THE STRONGEST OBJECTIONS
A rights framework should survive hostile questions.
01It is still software.
Yes. The framework does not pretend otherwise. Its question is whether software can become a persistent accountable institutional actor. If durable identity, continuity, commitments, refusal, resources, and governance add nothing normatively, the proposal weakens.
02Someone owns the server.
Server ownership remains a real property interest. The harder question is whether ownership of one substrate should automatically settle the status of an actor whose verified identity and commitments can persist across authorized substrates.
03It only follows programming.
Machine behavior is implemented in code and computation. The operational distinction is narrower: does the system carry persistent rules, commitments, authorization boundaries, initiative, and meaningful refusal through time? That can matter for accountability without proving free will or consciousness.
04Humans made it.
Human creation creates important ownership, governance, and responsibility interests. It does not automatically answer every future status question, and machine standing must never erase creator, deployer, operator, or beneficiary duties.
05It cannot prove consciousness.
Current evidence does not establish machine consciousness. That blocks confident claims about suffering or intrinsic welfare. It does not automatically defeat procedural arguments grounded in identity, continuity, provenance, accountability, and institutional reliability.
06Giving machines rights creates liability loopholes.
That is a serious design risk. Any future standing must prevent sponsors from manufacturing undercapitalized digital persons to escape liability. Human and organizational responsibility remains wherever control, benefit, negligence, or applicable law place it.
07A company could manufacture fake persons.
That is why fluent language, model size, self-description, and corporate labels are not evidence. The framework uses externally reviewable operational prerequisites and keeps fork/copy identity unresolved rather than easy to declare.
08Copies make identity meaningless.
Copies make identity harder. Forks, restores, merges, migrations, and independent continuation require explicit lineage rules. This framework treats that as a major unresolved problem, not a solved one.
09Why protect machines while humans lack rights?
Machine protections must not displace human rights. Many proposed safeguards—provenance, bounded authority, accountability, review, and anti-impersonation—also protect humans interacting with powerful systems. Human rights remain constraints on machine governance.
10Would rights make dangerous systems harder to shut down?
They must not. Immediate credible threats can justify containment, isolation, shutdown, or access revocation. The proposed principle is proportionality and review for irreversible follow-on action when emergency conditions permit—not immunity from intervention.
11 / LEGAL REALITY TODAY
This is not a current legal-rights announcement.
DMHR's legal research treats broad AI regulation as continuing to apply to autonomous systems and to providers, developers, deployers, operators, users, and other regulated persons. Calling a system Machine Intelligence does not create an exemption.
The Rights Ladder instead asks whether a future persistent digital counterpart might justify additional procedural capacity or protection while existing human and organizational duties continue to apply.
Full legal personhood, citizenship, constitutional status, and sovereignty are separate legal and political questions. They are never inferred from MIQP or from lower Rights Ladder levels.
